LMIA

What is LMIA?

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker. Getting a Labour Market Impact Assessment (LMIA) is an important step in getting a temporary work permit in Canada. Most people ask questions to our firm that they want to get an LMIA, but main key point is that LMIA is not given to an individual person, it is given to a business in Canada who is looking to hire a foreign worker to fill the labor shortage in their workplace.

We can help the Canadian employers for applying LMIA application and can represent them before Service Canada during the procedure. In order to obtain a positive LMIA, a Canadian employer must prove that there is no Canadian or permanent resident worker available to complete the job in question and a foreign worker is therefore required. A positive LMIA will show that there is a need for a foreign worker to fill the job. There are some industries, regions in Canada  where the employers are facing huge labor shortages and getting a temporary foreign worker could help them to fix that problem.

Once an employer gets the LMIA, the worker can apply for a work permit using that LMIA. LMIA used to support PR applications is another LMIA that may be used to get some extra CRS points for the Express entry program.

LMIAs are overseen by ESDC/ Service Canada and have an associated application fee of $1,000 for each temporary foreign worker position.

Types of LMIA :-

1.) Low-Wage LMIA

2.) High-Wage LMIA

3.) LMIA for Agricultural Workers

4.) LMIA for Seasonal Agricultural Workers

5.) LMIA to Support a Permanent Residency (PR) Visa Application

6.) LMIA for Global Talent Stream

The wage offered to a foreign worker determines under which stream to apply. If the salary paid to a worker is at or higher than a provincial or territorial median hourly wage, then the application is high-wage LMIA, otherwise, it will be Low-wage LMIA. Every LMIA has different requirements, and the rules, requirements keep on changing frequently.
